      Welcome to the Spiritual Laundry Membership Community (“Community”) operated by Defy Digital, Inc., doing business as, Spiritual Laundry. Please review the following terms and conditions concerning your use of and access to the Community as a member. By accessing, using, and/or participating in any activities, materials or content from the Community area of this website, including without limitation, classes, recordings, sessions, events, meditations, workshops, or any other activities hosted, sponsored, or affiliated by Spiritual Laundry (collectively, “Contents”), you are agreeing to be legally bound by these terms and conditions (“Agreement”), as well as the website disclaimer. If you do not agree with this Agreement or the website disclaimer, you may not be a member of the Community and/or use any of the Content made available on the Community area of this website offered by Spiritual Laundry.  

       

      1. MEMBER INFORMATION & AGREEMENTS

      You understand that you are eligible to become a member of the Community only if you are the age of 18 or older. You understand that your registration, as a member of the Community, is for your sole use. Further, you understand and agree that you may not authorize others to use your account and you may not assign or otherwise transfer your account to any other person or entity.

      You understand and agree that Spiritual Laundry may suspend or terminate your account or your membership in the Community at any time, for any reason or for no reason. Spiritual Laundry reserves the right to change, suspend, or discontinue all or any aspect of the Community and your membership at any time without notice

      You understand that in order to set up an account as a member of the Community, you will have to provide a user name, password, active email address, and, in some cases, a physical mailing address, all of which is subject to Spiritual Laundry’s Privacy Policy.  Any submission of false or materially inaccurate information by you in creating an account shall constitute a basis for Spiritual Laundry to terminate the account and bar you from accessing the Community area of the website. Further, you understand that you may only create one account per person, and any member creating multiple accounts with different email addresses may be subject to account termination.  

      You understand that any information presented in the Contents is educational in nature and is provided only as general information and is not medical or psychological advice, diagnosis, or treatment. Therefore, the Contents are not intended to be a substitute for seeking licensed health care advice or services and are intended solely for your own personal, non-commercial home use as educational self-help tools for personal growth and empowerment. If you experience any emotional distress or physical discomfort while participating in and/or viewing any Contents, you are advised to stop and to seek professional care, if appropriate.  

      You understand that by participating in some of the Contents, you will be receiving instruction and information concerning yoga, breathwork, meditation, energy healing, writing and spiritual practices, which may include breathing techniques, energy meditation, visualizations, and other mental and physical activities provided in the Contents. 

      You understand that you if you voluntarily choose to engage in any of the activities provided in the Contents, that such engagement may involve physical exercise and risks of serious injury, including permanent disability and death, which might result not only from your own actions, inactions, or negligence, but also that of other persons, the activities, or the condition of the premises or equipment used. 

      You acknowledge that Spiritual Laundry, the Contents and its instructors and teachers are not licensed health care professionals and do not provide any medical or psychological advice, diagnoses, or treatments.

      You understand and agree that if you are pregnant, or have a known cardiac arrhythmia (including very slow heart rate), a history of heart disease, or if you are taking antipsychotic medications that may result in an adverse reaction in connection with physical activities or breathwork, you will consult with and obtain the permission of a physician prior to engaging in any breathing techniques, walking meditation or other physical activities in connection with the Contents. 

      You understand and agree that you are responsible for maintaining the confidentiality of your account information and password and for restricting access to such information and to your computer. Further, you agree to accept responsibility for all activities that occur under your account or password.

      You understand and agree that it is your responsibility to determine that you are medically and psychologically able to participate in the Contents and, if necessary, to consult with a physician prior to and regarding your participation in the Contents. 

      You agree to conduct yourself in a safe and reasonable manner. You agree that you will not participate in the Contents while under the influence of drugs or alcohol and will not consume drugs or alcohol while participating in the Contents.

       

      2. CONTRAINDICATIONS FOR BREATHWORK

      Because Breathwork can allow for intense emotional and physical release, it is not advised to do Breathwork if you have a history of cardiovascular disease, high blood pressure, glaucoma, retinal detachment, aneurysms, osteoporosis, or recent surgery or physical injury. Additionally, Breathwork is not advised for people with severe mental illness or seizure disorders or someone with a history of panic attacks. Pregnant women are advised against practicing Breathwork and people with asthma should bring their inhalers and consult with their physician first. Breathwork is not recommended for anybody with a history of cardiovascular disease, high blood pressure, or heart problems.

       

      3. MEMBER REPRESENTATIONS AND WARRANTIES

      You represent and warrant that you have no physical or mental health condition that would prevent your safe participation in any of the Contents. 

      You represent and warrant that you are the age of 18 or older and have the right, authority and capacity to become a member of the Community. 

      You represent that you are competent and able to understand the nature and consequences of being a member of the Community and participating in any of the Contents. 

      You represent and acknowledge that you have carefully and completely read and fully understand all aspects of this Agreement. 

       

      4. LINKS TO THIRD-PARTY SITES

      The Community area of the website offers Content provided by third parties and may contain links or have references to websites controlled by parties other than Spiritual Laundry. Spiritual Laundry is not responsible for and does not endorse or accept any responsibility for the contents or use of such third-party websites and is providing these links to you only as a convenience. 

       

      5. MOBILE APPLICATION

      All Community Terms of Service or Release of Liability Agreements apply for the Mobile Application (“App”) operated by Defy Digital, Inc., doing business as Spiritual Laundry. The Community area of our website offers the Spiritual Laundry App, available on the iOS App Store as well as Google Android Store (referred to as the "App"). The App is governed by the same terms and conditions as the Community section of the website, including all related information, tools, and services. By downloading and/or using the App, you engage in our "Service" and agree to adhere to the following terms and conditions (Terms of Service & Release of Liability Agreement). These terms include any additional conditions and policies referenced herein or available via hyperlink. The Terms of Service & Release of Liability apply to all users of the App.

      1. Acceptance of Terms:By accessing or using the App, you confirm that you are at least 18 years old, or the age of majority in your jurisdiction, and that you agree to these Terms. If you are under the age of majority, you must have your parent or legal guardian's permission to use the App.

      2. Privacy Policy:Your privacy is important to us. Please review Spiritual Laundry’s Privacy Policy, which describes how we collect, use, and share your information.

      3. Use of the App:You agree to use the App only for lawful purposes and in accordance with these Terms. You agree not to use the App:

      • In any way that violates any applicable federal, state, local, or international law or regulation.
      • For the purpose of exploiting, harming, or attempting to exploit or harm minors in any way.
      • To transmit, or procure the sending of, any advertising or promotional material, including any "junk mail," "chain letter," "spam," or any other similar solicitation.
      • To impersonate or attempt to impersonate (Spiritual Laundry), a (Defy Digital) employee, another user, or any other person or entity.

       

      4. Account Registration:To access certain features of the App, you may be required to register to the Community. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete. You are responsible for safeguarding your password and for any activities or actions under your account.

      5. Intellectual Property:The App and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by (Defy Digital), its licensors, or other providers of such material and are protected by copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

      6. Termination:We may terminate or suspend your account and bar access to the App immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of these Terms. 

      If you're unhappy with the services provided by the App, you have the option to terminate or suspend your account whenever you wish. However, please note that doing so will not affect your Community agreement or any payments you've made, nor will it alter the terms outlined in the Terms of Service or Release of Liability Agreement.

      7. Changes to Terms:We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

       

      6. ORACLE DECKS (CARDS)

      All Community Terms of Service or Release of Liability Agreements apply for the Spiritual Laundry Oracle Decks usage operated by Defy Digital, Inc., doing business as Spiritual Laundry. The Spiritual Laundry Oracle Decks are designed for personal reflection and entertainment purposes only. By using these decks, you acknowledge and agree to the following terms and conditions:

      No Medical or Professional Advice:
      The cards in these decks do not provide medical, legal, financial, or professional advice. They are not intended to substitute for the services, advice, or expertise of licensed healthcare, legal, financial, or other professionals.

      Not for Diagnosis or Treatment:
      These cards are not created for diagnosing, treating, curing, preventing, or alleviating the effects of any medical conditions, mental health disorders, or other physical or psychological issues. They do not replace seeking qualified medical, mental health, or professional assistance.

      Spiritual and Inspirational Use:
      The Spiritual Laundry Oracle Decks are meant for spiritual insight, self-reflection, and personal inspiration. They are designed to assist individuals in exploring their thoughts, feelings, and emotions and to encourage personal growth and self-awareness.

      Not for Therapy or Counseling:
      These cards are not intended for therapeutic or counseling purposes. They should not be used as a substitute for professional therapy, counseling, coaching, or advisory services.

      Personal Responsibility:
      Users of the Spiritual Laundry Oracle Decks are solely responsible for their own energy, life choices, and the decisions they may make based on the reflection provided by the cards.

      Individual Interpretation:
      The interpretations and meanings attributed to the cards are subjective and personal. The user's interpretation of the cards is at their own discretion.

      Seek Professional Help:
      For any medical, mental health, legal, financial, or other professional concerns, it is strongly recommended to consult with licensed and qualified professionals in the relevant field.

      By using the Spiritual Laundry Oracle Decks, you acknowledge and agree to the terms and conditions outlined in this disclaimer. It is essential to exercise personal responsibility and discernment when using these cards and to consult appropriate professionals for any specific needs.

       

      7. INTELLECTUAL PROPERTY RIGHTS 

      You acknowledge that the Contents are protected by intellectual property rights of the respective owners of such intellectual property rights to their particular Contents. Therefore, you may not adapt, alter, modify, retransmit, rent, lease, loan, self-publish, distribute, post of social media, broadcast, communicate or make available to the public the Contents, in whole or in part, or create derivative works of the Contents. Any breach of the foregoing is a violation of Federal laws. 

       

      8. LIMITATIONS AND RELEASE OF LIABILITY

      THE CONTENTS ARE PROVIDED ON AN “AS IS” BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, WARRANTIES FOR A PARTICULAR PURPOSE. Therefore, by becoming a member of the Community and accessing the Contents, you agree to assume and accept full responsibility for any and all risks associated with participating in and/or viewing any of the Contents made available to you as a member and for applying what you may learn from participating in and/or viewing any Contents. Further, you agree and understand that this Agreement is intended to be a complete unconditional release of liability and assumption of risk to the greatest extend permitted by law.Spiritual Laundry and any third-party presenters of any Content accept no responsibility or liability whatsoever for your use or misuse of the Contents. 

       

      9. MISCELLANEOUS

      If any portion of this Agreement is held invalid, it is agreed that the balance of this Agreement shall continue in full force and effect. This Agreement sets forth the sole and entire understanding of the parties hereto relating to the subject matter hereof. Any and all matters in dispute between the parties to this Agreement, whether arising from or relating to this Agreement itself, or arising from alleged extra-contractual facts prior to, during, or subsequent to this Agreement, including, without limitation, fraud, misrepresentation, negligence or any other alleged tort or violation of the contract, shall be governed by, construed, and enforced in accordance with the laws of state of California, without regard to conflicts of law doctrines and regardless of the legal theory upon which such matter is asserted. This Agreement shall be binding upon you, your heir(s), and legal representative(s).

      For valuable consideration, the receipt of which is hereby acknowledged, by voluntarily becoming a member of the Community, you agree to forever fully release, indemnify, and hold harmless, Defy Digital, Inc,. its owner(s), officer(s) employee(s), and others associated with Defy Digital, Inc. from and against any and all claims or liability, of whatsoever kind or nature, which you may have for any loss, damage, or injury, including without limitation, physical, emotional, mental, legal, financial, personal, or otherwise, which you may incur arising at any time out of or in relation to your membership in the Community.
